What is a Section 32?
A Section 32 Vendor Statement is a disclosure document the seller must give you before you sign the contract. It's named after section 32 of the Sale of Land Act 1962 (Vic).
It tells you about the title, planning, outgoings, services and other matters affecting the property. It doesn't tell you everything, such as the condition of the building.
That's why it's worth reading with a property lawyer before you commit.
If the Section 32 is wrong or missing
Victorian law gives buyers some protection when the vendor statement falls short. What you can do depends on the circumstances.
You may have rights if:
- the seller didn't give you a signed Section 32 before you signed the contract
- information in the Section 32 is false
- information the law requires is missing
In some cases a buyer can end the contract before settlement. The seller may have defences, so get advice early rather than assuming.
You stay in control.
A review doesn't tell you that you have to buy the property. It gives you information before you make the decision. Depending on what we find, you may choose to:
