Eastern & North-Eastern Suburbs
Conveyancing in Box Hill.
Box Hill is the only suburb in Melbourne's east where a major state rail project, a rezoning and a high-rise apartment market all land on the same titles. Suburban Rail Loop East planning controls for the Box Hill precinct were gazetted on 14 July 2026 under Whitehorse Planning Scheme Amendment C255whse. More than half the homes here are apartments, so most transactions turn on the owners corporation, not the land.
Prepared reads the owners corporation certificate, the plan of subdivision and the planning position together. If there is a special levy coming, a building order on file, or an environmental audit still to be resolved, you should hear about it before you are contractually bound.

About Box Hill
Box Hill Central sits directly on top of the station and the bus interchange, and the block bounded by Whitehorse Road and Station Street now carries the tallest towers in Melbourne's east. Box Hill Hospital and Box Hill Institute anchor the north side. Immediately west, the Union Road and Mont Albert Road level crossings on the Lilydale and Belgrave line were removed and replaced with a single new Union station.
What the market here means for your contract
At the 2021 Census, 53.1% of occupied private dwellings in Box Hill were flats or apartments, 24.7% were townhouses or semi-detached, and only 22.0% were separate houses. It is the most apartment-dominated middle-ring suburb in this region.
That changes where the risk sits. Owners corporation records, the maintenance fund, defect history and any building notice or order matter more than easements or covenants for most Box Hill purchases.
Before you sign
In Victoria you get three clear business days to cool off, and none at all if you buy at auction.
That is the whole window. A contract read after settlement is a bill, not advice. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.

What we check in Box Hill
Suburban Rail Loop rezoning and acquisition
Box Hill is one of the Suburban Rail Loop East station precincts. Amendment C255whse was gazetted on 14 July 2026, rezoning land to the new Precinct Zone and introducing Built Form, Parking and Environmental Audit overlays. Land is also being acquired for the station box and construction sites, so check the planning certificate for a Public Acquisition Overlay and the vendor statement for any notice of acquisition.
Owners corporation certificate and special levies
With most homes in apartment buildings, the owners corporation certificate under section 151 of the Owners Corporations Act 2006 is the main document. Read it for special levies struck or foreshadowed, the maintenance fund balance, current or threatened litigation, defect claims and any building notice or order. A rectification program agreed after settlement can still land on you as the incoming owner.
Combustible cladding on newer towers
Combustible cladding rectification remains a live issue across Victorian apartment buildings, and Box Hill has a large stock built since around 2010. Ask whether the building has been assessed, whether rectification works are planned or under way, and how they are being funded. The answers belong in the owners corporation records, not in the agent's brochure.
Environmental Audit Overlay on rezoned land
Amendment C255whse applied an Environmental Audit Overlay to potentially contaminated sites in the precinct, reflecting Box Hill's long commercial and light-industrial history around the station. Where the overlay applies, a residential use generally cannot commence until an audit statement or certificate is issued. On an off-the-plan purchase that can delay the occupancy permit and, with it, settlement.
Off-the-plan contracts and sunset dates
Box Hill has a high volume of off-the-plan apartment stock and those contracts often run for years. Check the sunset date, the developer's rights to rescind and the limits on those rights, and how the plan of subdivision may change before registration. Duty is calculated differently on an off-the-plan purchase, so confirm the position early rather than at settlement.

Common questions
What does the Suburban Rail Loop mean if I am buying in Box Hill?
Box Hill is one of the Suburban Rail Loop East station precincts, and planning controls for it were gazetted on 14 July 2026 under Amendment C255whse. That amendment rezoned land to a new Precinct Zone and introduced Built Form, Parking and Environmental Audit overlays. Land is also being acquired for construction. Check the planning certificate for a Public Acquisition Overlay and ask your conveyancer to confirm how the new controls apply to the specific title.
What should I check in an owners corporation certificate for a Box Hill apartment?
Start with special levies, either struck or foreshadowed, and the maintenance fund balance. Then look for current or threatened litigation, defect claims, and any building notice or order on the building. Cladding rectification is the most common reason a Victorian apartment building suddenly needs a large contribution from owners. The certificate is issued under section 151 of the Owners Corporations Act 2006 and should be obtained before you sign.
Why does an Environmental Audit Overlay matter for a Box Hill apartment?
Where an Environmental Audit Overlay applies, a sensitive use such as housing generally cannot commence until an environmental audit statement or certificate of environmental audit is issued. Box Hill has a commercial and light-industrial history around the station, and the overlay was extended over potentially contaminated sites by Amendment C255whse, gazetted 14 July 2026. On an off-the-plan purchase, an unresolved audit can hold up the occupancy permit and delay settlement.
