Western Suburbs

Conveyancing in Sunshine.

Sunshine grew up around a harvester works and a rail junction, and both are still shaping it. The station is being rebuilt as a regional hub, and roughly three in ten homes are now attached dwellings on land that was once a single large block. Change of that kind shows up in the contract.

Prepared checks what the planning certificate discloses about the land and its history, works through the owners corporation records on newer attached homes, and looks for anything on the title connected to the rail works nearby.

About Sunshine

Hampshire Road is the main shopping strip, running down to Sunshine station where the Sunbury, Ballarat, Bendigo and Geelong-bound lines converge. The old Sunshine Harvester works site and the surrounding rail land set out the suburb's grid. Kororoit Creek runs along the western edge.

What the market here means for your contract

At the 2021 Census, Sunshine had 3,365 occupied private dwellings. Separate houses made up 69.2%, semi-detached homes and townhouses 22.1%, and flats or apartments 8.3%.

Around three in ten homes are now attached, which is the signature of sustained subdivision of the original large allotments. That means a Sunshine file often involves a relatively new dwelling on relatively old land, and the two carry different questions.

Before you sign

In Victoria you get three clear business days to cool off, and none at all if you buy at auction.

That is the whole window. A contract read after settlement is a bill, not advice. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.

What we check in Sunshine

Melbourne Airport Rail works at Sunshine

Sunshine station is being rebuilt as a regional hub, with two new regional platforms, an upgraded bus interchange, new forecourts and open space, and capacity designed for more than a thousand trains a day. The West Footscray to Albion Rail Upgrade, which is stage one of Airport Rail, is due for completion in 2030. Check the title and the section 32 for anything registered in connection with the works, and factor construction activity into your expectations for the are

A century of industrial land use

The Sunshine Harvester works, later Massey Ferguson, and extensive rail workshop and industrial land shaped the suburb. Land with that history can raise contamination questions that need to be resolved before a residential use is assumed, and the issue matters most on subdivision and redevelopment sites. Ask your conveyancer to check the planning certificate and confirm whether any environmental audit documentation exists.

Buying a subdivision site

Sunshine's large original allotments make it a subdivision market, and buyers often pay for development potential rather than the existing house. Development potential depends on the zone, on any control disclosed in the planning certificate, and on what has to be resolved about the land before a residential use can start. Confirm all three before you price the site.

Planning change around the station

Land use rules around a major station precinct do not stay still. Rezoning can change what may be built, and it can bring new contribution levies with it. Check the planning scheme as it stands at the date of your contract, and ask whether any amendment is on exhibition, because a buyer relying on today's controls can be affected by a change already in train.

Owners corporation records on newer townhouses

More than a fifth of Sunshine homes are semi-detached or townhouses, most of them recent. Obtain the owners corporation certificate and read it for levies, the maintenance fund, and any defect or repair matter already raised. On newly built attached homes, also check what builder's warranty cover remains and what has already been claimed.

Common questions

How will the Sunshine station works affect buying property nearby?

Sunshine station is being rebuilt as a regional hub with two new regional platforms, an upgraded bus interchange and new forecourts and open space. The West Footscray to Albion Rail Upgrade, stage one of Melbourne Airport Rail, is due for completion in 2030. Before buying nearby, check the title and section 32 for anything registered in connection with the works, and allow for construction activity in the meantime.

Is Sunshine land affected by its industrial history?

It can be, and it is worth checking rather than assuming. The Sunshine Harvester works, later Massey Ferguson, and extensive rail workshop and industrial land shaped the suburb over more than a century. Land with that history can raise contamination questions that must be resolved before residential use is assumed, so have the planning certificate checked and ask whether environmental audit documentation exists for the title.

What should I check before buying a Sunshine block to subdivide?

Check three things before you price it. The zone that applies to the land, anything disclosed on the planning certificate in the section 32 that limits development, and whether the land's former use raises contamination questions that must be resolved before a residential use can start. Any one of them can change what the site is worth to you.
