No charge. No obligation. No credit card. You're not limited to one property.

Government charges, searches and transfer duty are additional and are payable to the relevant authorities or third parties. No hourly billing. No surprise legal bill. No pressure either way.

Lawyer or conveyancer?

Lawyer or conveyancer? Here's the difference.

In NSW, both solicitors and licensed conveyancers can review a property contract. The difference is the scope of what each is allowed to do.

A licensed conveyancer can do conveyancing work and give legal advice about the transfer of title.

A lawyer holds a practising certificate and can do general legal work and give legal advice beyond the transfer itself.

Both carry professional indemnity insurance, and client money they hold is protected by statutory compensation funds. The wider scope can matter when a contract raises questions outside a standard transaction.

What's included

What does a lawyer's contract review include?

We read both documents in full and flag what deserves your attention. Your review is done by Australian property lawyers who work in NSW property law.

Prepared_Icon_Files
  • Contract of Sale We look at the terms and conditions, including special conditions, settlement provisions and buyer obligations.
  • Attached documents We review the information provided about the property and identify matters that may need attention or further investigation.
  • Special conditions Special conditions can materially change the standard transaction. We'll explain the ones that matter.
  • Title and restrictions We'll identify relevant easements, covenants and other restrictions appearing in the documents.
  • Strata Where relevant, we’ll flag strata information and issues that may affect the property.
  • What happens next We'll explain the practical next steps so you know what to ask, investigate or negotiate before proceeding.
Contract of Sale

What is a Contract of Sale?

The Contract of Sale sets out the deal you're agreeing to. It records the terms of the property transaction, including the purchase price, deposit, settlement date and the obligations of the buyer and seller.

But the important parts aren't always obvious. Special conditions can change how the standard transaction works. They can create additional obligations, alter settlement arrangements or affect what happens if something goes wrong.

That's why it's worth having the contract reviewed before you sign.

What’s attached

What’s attached to an NSW contract?

The seller must attach the prescribed documents to the contract: the title search, all plans and dealings, the drainage and sewerage diagrams and the council planning certificate, plus pool registration and compliance documents if there’s a pool. For apartments, the common property search and by-laws.

It can include information relating to:

  • ownership and title
  • mortgages and other registered interests
  • easements
  • covenants
  • planning
  • strata manager and by-laws
  • drainage and sewerage
  • notices and charges
  • services

The above list is not a complete list. Every property is unique. What's disclosed, what's missing and what it means can matter before you commit to the purchase.

Found a problem?

You stay in control.

A review doesn't tell you that you have to buy the property. It gives you information before you make the decision. Depending on what we find, you may choose to:

Prepared_Icon_Insight
  • Walk away If the property or contract isn't right for you.
  • Negotiate Ask for a change to the contract, price or other terms.
  • Investigate further Get the right building, pest, planning or other advice.
  • Proceed Move forward knowing what you're agreeing to.
Buying at auction?

Get your contract reviewed before you bid.

Auction purchases are different. In NSW there’s no cooling-off at auction, or for a contract exchanged on the same day after a pass-in. That makes understanding the contract before you bid particularly important.

If you're considering bidding at auction, send us the contract before auction day so we can review it and suggest amendments to the contract that benefit you and suit what you need.

More than one property?

Send them all.

You're not limited to one property. If you're still searching, you can use Prepared to review the contracts you're considering before you decide which property is right for you. No charge. No obligation.

The right time to get legal advice isn't after you've bought the property. It's before you commit.
