Inner Sydney

Conveyancing in Glebe.

Glebe takes its name from church land, granted in 1790 for the maintenance of church and school and later let on building leases, St Phillips in 1842 and Bishopthorpe in 1856.

Under a contract of 14 May 1974 the Commonwealth bought the church's Glebe housing to rehabilitate it, and in the mid 1980s the estate passed to the NSW Government, whose Land and Housing Corporation still owns homes there. Almost all of Glebe is regulated by Sydney LEP 2012, but a notable exception is a former public housing site in the block bounded by Wentworth, Bay and Cowper Streets, which remains subject to its own plan, Sydney LEP (Glebe Affordable Housing Project) 2011.

Prepared reviews your contract for sale and the documents prescribed to be attached to it against what Glebe actually raises. Which local environmental plan the certificate names, and whether the land sits in one of Glebe's heritage conservation areas. Whether the street drains to Blackwattle Bay or Johnstons Creek, and what the certificate reports on flooding. Whether you are buying a terrace on its own title or a lot in a strata scheme, because the searches are different. You get answers you can act on before the cooling off period runs out.

About Glebe

Glebe runs from Broadway and Parramatta Road in the south to the foreshores of Blackwattle Bay and Rozelle Bay in the north, with Ultimo to the east and Forest Lodge and Annandale to the west. Glebe Point Road is the main street. There is no railway station: the L1 Dulwich Hill light rail line runs through the suburb along the old goods line corridor, with stops at Glebe and Jubilee Park. Wentworth Park was laid out on the reclaimed Blackwattle Swamp, where reclamation was nearing completion in late 1879, and it opened as a recreation area in September 1882.

Lyndhurst at 61 Darghan Street, the villa designed by John Verge and completed about 1837, is on the State Heritage Register as item 00158. Glebe Municipal Council was abolished from 1 January 1949, Leichhardt Council took over responsibility for Glebe in 1968, and Glebe and Forest Lodge were transferred back to the City of Sydney from 8 May 2003. The new Sydney Fish Market opened at the head of Blackwattle Bay on 19 January 2026.

What the market here means for your contract

At the 2021 Census, Glebe had 11,680 residents in 6,438 private dwellings, with an average household size of 2 people. Semi-detached, row or terrace houses and townhouses made up 47.2% of occupied private dwellings, flats or apartments 46.0% and separate houses 5.0%. Of occupied private dwellings, 61.4% were rented, 15.7% owned with a mortgage and 19.4% owned outright. That is a different mix from Ultimo, where flats or apartments were 87.4%, and Haymarket, where they were 98.8%.

The practical effect is that a Glebe conveyancing file can be one of two quite different things. For a terrace, the work often lies in the title and any registered easements or restrictions, the sewer service diagram, which shows the private pipes and whether any cross the property, and the heritage controls that will govern later alterations. For an apartment, the key due-diligence issues often lie in the section 184 certificate, the by-laws, the capital works fund and the owners corporation records, which for many purchasers provide a more meaningful picture of the rights, obligations and financial exposures associated with the lot than the contract alone.

Before you sign

In New South Wales you get 5 business days to cool off on an established home, 10 for off the plan, and none at all at auction. If you agree to waive the cooling off period and provide a 66W Certificate then no cooling off applies as well.

That is the whole window. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.

What we check in Glebe

A separate plan for one Glebe site

The City of Sydney lists Sydney Local Environmental Plan (Glebe Affordable Housing Project) 2011 among the plans that apply in its area. It took effect on 1 July 2011 and covers a site within the block bounded by Wentworth Street, Bay Street and Cowper Street, where 1950s and 1960s public housing was demolished for a redevelopment by the NSW Land and Housing Corporation. A 2016 council report records a Stage 1 consent for 495 dwellings across social, affordable and market housing, and notes that Sydney LEP 2012 and the Sydney DCP 2012 do not apply to the site. Consequently, a section 10.7 certificate for an apartment on that site may identify the 2011 plan as the applicable planning instrument. We read which instrument the certificate for your address names rather than assuming.

Conservation areas and the 2026 map changes

The Glebe Society describes virtually all of Glebe and Forest Lodge as covered by heritage conservation areas under Sydney LEP 2012, among them the St Phillips conservation area and the Hereford and Forest Lodge conservation area (C33). Within a conservation area, the Sydney DCP 2012 building contributions map shows how a building contributes to the area's character, and works to a place in a conservation area may need a development application unless a heritage exemption applies. The City's Conservation Areas Review amendment to Sydney LEP 2012, published on 23 January 2026, updated some conservation area boundary maps. A map or certificate obtained before that date may be out of date, so we read the current certificate for your address.

Two flood catchments and a reclaimed swamp

The City of Sydney places Glebe in the Blackwattle Bay floodplain catchment and parts of Glebe in the Johnstons Creek catchment, each with a floodplain risk management plan adopted by the council in May 2015. Wentworth Park sits on the reclaimed Blackwattle Swamp, and the council's planning proposal for State-owned land on Cowper Street and Wentworth Park Road recorded that the sites are affected by the 1% annual exceedance probability flood level, experience overland flooding, and may encounter acid sulfate soils, which Sydney LEP 2012 deals with in clause 7.14. Flood and acid sulfate soil controls are applied by map, so whether a particular address is affected is a question for the section 10.7 certificate and the council's flood information.

What is planned across Blackwattle Bay

The Blackwattle Bay precinct, which takes in the former Sydney Fish Market site in Pyrmont, was rezoned by a State environmental planning policy amendment published on 16 December 2022, which inserted clauses 6.67 to 6.71 into Sydney LEP 2012. The NSW Government says the rezoning allows approximately 1,200 apartments, and the amendment added overshadowing limits protecting Wentworth Park and the Glebe Foreshore Parks. The new Sydney Fish Market opened at the head of the bay on 19 January 2026. Those controls apply to the precinct land, so the section 10.7 certificate for a Glebe apartment facing the bay generally will not mention them. If the outlook matters to you, we point you to what has been approved across the water before you rely on it.

Rezoned public housing land nearby

Sydney LEP 2012 also carries site-specific clauses in Glebe. Clause 6.54, inserted by Amendment No 68 in September 2021, applies to 17 to 31 Cowper Street and 2A to 2D Wentworth Park Road, land owned by the NSW Land and Housing Corporation. It sets floor space ratios of 3.1:1 and 4.3:1 for the two sites and requires all residential floor space on the northern site to be affordable housing provided by or on behalf of a public authority or social housing provider, and the same rezoning took the land out of the St Phillips conservation area. The Glebe Society describes the State as Glebe's largest landowner. When you buy near State-owned land, the controls on the neighbouring site may differ from those on your certificate.

How we help in Glebe

Contract for sale reviews

Before you sign anything, we review the contract for sale and explain the terms, special conditions and risks that could affect your purchase.

Prescribed documents and the 10.7 certificate

The documents attached to the contract carry the section 10.7 planning certificate, the title and plan, the sewerage diagram, easements and restrictions, and for strata the scheme documents and by-laws. We explain what they mean and flag anything that deserves a closer look.

Property conveyancing

Buying or selling, we manage the legal transfer of ownership, prepare the documents and coordinate every party through to settlement.

Settlement and statement of adjustments

We prepare and check settlement figures, including council rates, water rates, strata levies and other adjustments, so nothing is wrong on the day.

Electronic settlement

Land dealings in New South Wales must be lodged electronically, and certificates of title were cancelled in October 2021. We run the whole process securely and keep you informed at each step.

Strata due diligence

Buying an apartment or townhouse means buying into a strata scheme. We review the section 184 certificate, the records, financial statements, by-laws, the capital works fund, maintenance obligations and any known issues.

Easements, covenants and title restrictions

We explain everything affecting the title, including easements, restrictions on the use of land and positive covenants created by a section 88B instrument, caveats, mortgages and other registered interests that could limit what you do with the property.

Transfer duty and land tax clearance

We calculate your duty, prepare the documents and lodge everything with Revenue NSW, and we obtain the land tax clearance certificate so an unpaid charge on the land does not follow you.

Common questions

Which council is Glebe in?

Glebe is in the City of Sydney local government area. Glebe and Forest Lodge were transferred to the City of Sydney from 8 May 2003, after Leichhardt Council had administered Glebe since 1968, so approvals for older building work on a Glebe property may have been issued by Leichhardt Council. Almost all of Glebe is regulated by Sydney LEP 2012, with a notable exception for a site in the block bounded by Wentworth, Bay and Cowper Streets, which has its own 2011 plan.

Is Glebe in a heritage conservation area?

Much of it is. The Glebe Society describes virtually all of Glebe and Forest Lodge as covered by heritage conservation areas, including the St Phillips and the Hereford and Forest Lodge conservation areas, and Glebe has State Heritage Register items such as Lyndhurst in Darghan Street. Conservation areas and heritage items are applied by map, not by suburb, so whether a particular address is affected is a question for the section 10.7 certificate and the City of Sydney's maps for that address, some of which changed with an amendment published on 23 January 2026.

How long is the cooling off period when I buy in Glebe?

5 business days for an established home and 10 business days off the plan. There is no cooling off if you buy at auction, or if you agree to waive it and a section 66W certificate is provided. Before you sign, check the contract has its prescribed documents attached, including the section 10.7 planning certificate, the sewerage diagram, the title documents and, for an apartment, the strata scheme documents and by-laws. If any are missing, you can rescind the contract within 14 days of it being made.
