Conveyancing in Chippendale.
Almost all property in the City of Sydney is regulated by Sydney LEP 2012.
A notable exception is the former Carlton & United Breweries site at Chippendale, now known as Central Park (Frasers Broadway), which remains subject to Sydney LEP 2005. Consequently, a section 10.7 planning certificate for an apartment in Central Park may identify Sydney LEP 2005 as the applicable planning instrument, while neighbouring properties are generally subject to Sydney LEP 2012.
Prepared reviews your contract for sale and the documents prescribed to be attached to it against what Chippendale actually raises. Which local environmental plan the certificate names. What the certificate reports on contamination, which on a former brewery and industrial suburb is far less than buyers assume. The strata records behind an apartment that is almost certainly in a scheme. Whether the building sits on the Building Commission register of building work orders. You get answers you can act on before the cooling off period runs out.

About Chippendale
The Sydney Development Control Plan 2012 locality statement describes Chippendale as bounded by Broadway to the north, Lee Street and Regent Street to the east, City Road to the west and Cleveland Street to the south. Four of those edges are classified State roads: Broadway is the Great Western Highway, City Road is the Princes Highway, and Regent Street and Cleveland Street are both classified in the Transport for NSW schedule. The same locality statement describes the scale as generally low to medium rise apart from the blocks fronting Parramatta Road and Regent Street, and asks that street tree plantings in Bartley, Balfour and Buckland Streets be maintained.
Mortuary Station on Regent Street, the 1869 funeral train terminus by Colonial Architect James Barnet, is on the State Heritage Register as item 00157, gazetted 2 April 1999. Peace Park at 70 to 80 Myrtle Street stands on a former film laboratory factory site that the council bought in 1978 and opened as a park in 1985, named to reflect public support for nuclear disarmament. Chippendale has no station of its own. Redfern sits immediately to the south east and Central is at the north eastern corner.
What the market here means for your contract
At the 2021 Census, Chippendale had 7,803 residents in 4,832 private dwellings, with an average household size of 1.8 people. Flats or apartments made up 88.2% of occupied private dwellings, semi-detached houses, row or terrace houses and townhouses 9.8%, and separate houses 0.1%. Of occupied private dwellings, 76.0% were rented, 12.7% owned with a mortgage and 8.8% owned outright. Studios and one bedroom dwellings together accounted for 57.5%.
The practical effect is that a Chippendale conveyancing file is usually a strata file. Unlike a detached-house suburb, the key due-diligence issues often lie in the Section 184 certificate, the by-laws, the capital works fund and ten-year capital works fund plan, strata committee and owners corporation records, and any embedded network arrangements. For many purchasers, those documents provide a more meaningful picture of the rights, obligations and financial exposures associated with the lot than the contract alone.
Before you sign
In New South Wales you get 5 business days to cool off on an established home, 10 for off the plan, and none at all at auction. If you agree to waive the cooling off period and provide a 66W Certificate then no cooling off applies as well.
That is the whole window. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.
Local detail
What we check in Chippendale
Two local environmental plans, one suburb
The City of Sydney states that Sydney Local Environmental Plan 2005 now applies only to Frasers Broadway, the former Carlton and United Brewery site, and lists Sydney Local Environmental Plan 2012 as applying to most of the local area. Sydney Local Environmental Plan 2005 clause 23 names that site and requires a development plan to be in force before consent can be granted. The land also carries Part 3A concept plan approval MP06_0171, approved 9 February 2007 and modified many times since. We read which instrument the certificate for your address names rather than assuming the 2012 plan applies.
What a 10.7 certificate does not say
A section 10.7(2) certificate must be attached to the contract and reports the matters prescribed by Schedule 2 of the Environmental Planning and Assessment Regulation 2021, in force from 1 October 2022. On contamination it states only whether the land is significantly contaminated land, subject to a management order, the subject of an approved voluntary management proposal, subject to an ongoing maintenance order, or the subject of a site audit statement a copy of which was given to the council. It does not certify that land is clean and it does not disclose a former brewery or industrial use. A section 10.7(5) certificate carries additional council advice, cannot have its contents prescribed, and does not have to be attached to the contract. We ask for both.
Strata records are the real search
A section 184 certificate under the Strata Schemes Management Act 2015 shows the committee and managing agent, the levies, any levies outstanding on the lot, proposals for funding the ten year capital works plan, by-laws made in the last six months and not yet lodged, whether a strata renewal committee exists, and whether the scheme has an embedded network. If a levy is outstanding but not shown on the certificate, the purchaser is not responsible for paying it. The certificate is not the same thing as inspecting the records, which is where the finances, insurance, defects, planned works and disputes actually appear.
Defect protection in newer apartment buildings
Home building compensation cover is not required for new buildings with a rise in storeys of more than three containing multiple home units. For those buildings the protections are different. The strata building bond is 2% of the total construction contract price, lodged before an occupation certificate is applied for, with an interim inspection 15 to 18 months and a final inspection 21 to 24 months after completion. Section 37 of the Design and Building Practitioners Act 2020 owes a duty of care to each owner, including later owners. Building Commission NSW can act on serious defects in class 2, 3 and 9c buildings for up to ten years after completion, and publishes orders while they remain in force.
Water and sewerage at Central Park
Sydney Water is the public utility across Greater Sydney, but the Central Park development on Broadway is served by a scheme licensed under the Water Industry Competition Act 2006. IPART's register records Altogether Central Park Pty Ltd as network operator and Altogether Group Pty Ltd as retailer, covering drinking water, recycled water and sewerage, with Sydney Water named as last resort provider. A purchaser there contracts with a licensed private retailer rather than with Sydney Water, and the arrangement is an embedded network the owners corporation must disclose. We confirm who supplies the address rather than assuming.

How we help in Chippendale
Contract for sale reviews
Before you sign anything, we review the contract for sale and explain the terms, special conditions and risks that could affect your purchase.
Prescribed documents and the 10.7 certificate
The documents attached to the contract carry the section 10.7 planning certificate, the title and plan, the sewerage diagram, easements and restrictions, and for strata the scheme documents and by-laws. We explain what they mean and flag anything that deserves a closer look.
Property conveyancing
Buying or selling, we manage the legal transfer of ownership, prepare the documents and coordinate every party through to settlement.
Settlement and statement of adjustments
We prepare and check settlement figures, including council rates, water rates, strata levies and other adjustments, so nothing is wrong on the day.
Electronic settlement
Land dealings in New South Wales must be lodged electronically, and certificates of title were cancelled in October 2021. We run the whole process securely and keep you informed at each step.
Strata due diligence
Buying an apartment or townhouse means buying into a strata scheme. We review the section 184 certificate, the records, financial statements, by-laws, the capital works fund, maintenance obligations and any known issues.
Easements, covenants and title restrictions
We explain everything affecting the title, including easements, restrictions on the use of land and positive covenants created by a section 88B instrument, caveats, mortgages and other registered interests that could limit what you do with the property.
Transfer duty and land tax clearance
We calculate your duty, prepare the documents and lodge everything with Revenue NSW, and we obtain the land tax clearance certificate so an unpaid charge on the land does not follow you.

Common questions
Which council is Chippendale in?
Chippendale sits in the City of Sydney local government area. The council administers Sydney Local Environmental Plan 2012 and the Sydney Development Control Plan 2012, which carries a Chippendale locality statement at section 2.3.1. The City of Sydney is not always the consent authority in its own area, and the council itself notes that state planning policies and ministerial thresholds can shift that for larger development.
Is Chippendale in a heritage conservation area?
There is a Chippendale Heritage Conservation Area, identified as C9 in two City of Sydney Local Planning Panel reports. Within a conservation area individual buildings are graded as contributory, neutral or detracting, and the council publishes a building contributions map alongside its heritage items map. Conservation areas and heritage items are applied by map, not by suburb, so whether a particular address is affected is a question for the section 10.7 certificate and the council's maps for that address.
How long is the cooling off period when I buy in Chippendale?
5 business days for an established home and 10 business days off the plan. There is no cooling off if you buy at auction, or if you agree to waive it and a section 66W certificate is provided. Before you sign, check the contract has its prescribed documents attached, including the section 10.7 planning certificate, the sewerage diagram, the title documents and, for an apartment, the strata scheme documents and by-laws. If any are missing, you can rescind the contract within 14 days of it being made.
