Conveyancing in Haymarket.
Part of Haymarket is regulated principally by a State planning policy rather than the council's local environmental plan.
The City of Sydney lists Darling Harbour as an area controlled by the State policy for Eastern Harbour City precincts, with the Minister for Planning as consent authority for larger projects, and planning reports place Darling Square and the Market City and Paddy's Markets block inside that precinct. Consequently, a section 10.7 planning certificate for an apartment there may identify the State policy, while the Chinatown Special Character Area next door is generally subject to Sydney LEP 2012.
Prepared reviews your contract for sale and the documents prescribed to be attached to it against what Haymarket actually raises. Which planning instrument the certificate names, and who decides a development application on the next site. Whether a Chinatown building was heritage listed after the certificate was issued. The strata management statement behind an apartment built over shops. What the 2025 rezoning at Central allows nearby. You get answers you can act on before the cooling off period runs out.

About Haymarket
Haymarket is the southern end of the city centre, between Darling Harbour and Central. The City of Sydney treats it as one precinct in three parts, Central, Chinatown and Haymarket, and names Darling Square within it. Light rail runs along Hay Street, and Central gained metro platforms when Sydney Metro City opened on 19 August 2024. The NSW Government counts Haymarket as one of six neighbourhoods in Tech Central, its innovation district around the station.
The Municipal Markets opened at Haymarket in 1912 and moved to Flemington in 1975. Market Buildings 1 and 2, home to Paddy's Markets beneath the Market City centre, are on the section 170 heritage register kept under the Heritage Act 1977 by Place Management NSW, not on the State Heritage Register. Sydney LEP 2012 lists the Chinatown ceremonial gates and lion statues on Dixon Street (item I2301) and the former Kwong War Chong & Co building at 82 to 84 Dixon Street (I2293). On 6 May 2026 the council added three more Chinatown buildings, including the 1916 tong clubhouses at 50 to 54 Dixon Street and the Kuo Min Tang building at 75 to 77 Ultimo Road, its headquarters since 1921.
What the market here means for your contract
At the 2021 Census, Haymarket had 8,305 residents in 3,005 occupied private dwellings, with an average household size of 2.4 people. Flats or apartments made up 98.8% of occupied private dwellings, semi-detached houses, row or terrace houses and townhouses 0.4%, and separate houses 0.2%. Of occupied private dwellings, 75.6% were rented, 10.3% owned with a mortgage and 9.5% owned outright. Two bedroom dwellings were the largest group at 53.5%, and 58.5% of households had no registered motor vehicle.
The practical effect is that a Haymarket conveyancing file is usually a strata file, and often one in a building shared with shops, a market or a shopping centre. The section 184 certificate, the by-laws and the capital works fund still matter, and where the residential scheme occupies only part of the building, the strata management statement that governs the building and its site is part of the same picture. With three in four homes rented in 2021, many purchases also come with a tenant in place, so the tenancy documents and the date vacant possession can be given need reading alongside the contract.
Before you sign
In New South Wales you get 5 business days to cool off on an established home, 10 for off the plan, and none at all at auction. If you agree to waive the cooling off period and provide a 66W Certificate then no cooling off applies as well.
That is the whole window. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.
Local detail
What we check in Haymarket
Darling Harbour land under a State policy
The City of Sydney lists Darling Harbour as an area where the controls are the State planning policy for Eastern Harbour City precincts and the Sydney Development Control Plan 2012, with the Minister for Planning as consent authority for larger projects. A City of Sydney Local Planning Panel report of 20 December 2023 placed the Market City and Paddy's Markets block, bounded by Hay, Thomas, Ultimo Road and Quay Streets, in the Development Area under Chapter 3 of that policy, which took over the provisions of the former Darling Harbour Development Plan No 1. The 2013 environmental impact statement for the Darling Square residential stage likewise placed that land within the Darling Harbour precinct. Parts of Darling Harbour are State land held under long leases, so we read which instrument the certificate for your address names and check the title search for whether the lot is freehold or leasehold.
Chinatown heritage listings made in 2026
On 6 May 2026 the City of Sydney added three Chinatown buildings to Sydney LEP 2012 as local heritage items: 50 to 54 Dixon Street, 90 to 100 Hay Street and 75 to 77 Ultimo Road. They join existing items such as the Chinatown ceremonial gates and lion statues (I2301) and the Convent Garden Hotel at 102 to 108 Hay Street (I853), and the council designates Chinatown a Special Character Area with its own planning rules. A section 10.7 certificate speaks as at the date it issues, so a certificate obtained before 6 May 2026 will not reflect the new listings. We check the certificate date and, for a lot in or beside a listed building, what the listing may mean for works the owners corporation is planning.
Apartments built over shops and markets
A City of Sydney panel report of 20 December 2023 describes Paddy's Markets on the ground floor beneath the Market City shopping centre and a residential tower, and Darling Square mixes apartments with retail, dining and student accommodation. Where a strata plan creates a part strata parcel, meaning the scheme occupies only part of a building, Part 6 of the Strata Schemes Development Act 2015 deals with the strata management statement for the building and its site, and section 108 treats an earlier registered building management statement as that statement. The section 184 certificate is not a substitute for it. We obtain the statement and read how shared facilities, costs and decisions are divided between the residential scheme and the other owners in the building.
Rezoning at Central next door
In August 2025 the Minister for Planning approved a revised rezoning proposal for the Central Precinct, the rail land bounded by Pitt, Cleveland, Eddy and Elizabeth Streets, and the Department of Planning, Housing and Infrastructure says development applications for sites there can now be lodged. The Department expects it to enable about 950 new homes, 30% of them affordable housing. The Western Gateway blocks beside the station were rezoned earlier, in August 2020 and October 2021. A section 10.7 certificate describes the controls on the lot being bought, not on the land across the road, so for an apartment overlooking the rail yards we point you to the rezoning documents for what may be built in your outlook.
Flood planning in the Darling Harbour catchment
The City of Sydney's Darling Harbour floodplain catchment covers about 307 hectares, including Haymarket, Surry Hills and parts of Pyrmont and Ultimo, and the council adopted its flood study, floodplain risk management study and plan in August 2016. The December 2023 panel report recorded that the Sydney Development Control Plan 2012 identifies the Market City site as affected by flooding. Flood controls are applied by map, lot by lot, so we read the hazards and risks the section 10.7 certificate reports for the address and, for a lower-level lot or a car space, the owners corporation records for any history of water entry.

How we help in Haymarket
Contract for sale reviews
Before you sign anything, we review the contract for sale and explain the terms, special conditions and risks that could affect your purchase.
Prescribed documents and the 10.7 certificate
The documents attached to the contract carry the section 10.7 planning certificate, the title and plan, the sewerage diagram, easements and restrictions, and for strata the scheme documents and by-laws. We explain what they mean and flag anything that deserves a closer look.
Property conveyancing
Buying or selling, we manage the legal transfer of ownership, prepare the documents and coordinate every party through to settlement.
Settlement and statement of adjustments
We prepare and check settlement figures, including council rates, water rates, strata levies and other adjustments, so nothing is wrong on the day.
Electronic settlement
Land dealings in New South Wales must be lodged electronically, and certificates of title were cancelled in October 2021. We run the whole process securely and keep you informed at each step.
Strata due diligence
Buying an apartment or townhouse means buying into a strata scheme. We review the section 184 certificate, the records, financial statements, by-laws, the capital works fund, maintenance obligations and any known issues.
Easements, covenants and title restrictions
We explain everything affecting the title, including easements, restrictions on the use of land and positive covenants created by a section 88B instrument, caveats, mortgages and other registered interests that could limit what you do with the property.
Transfer duty and land tax clearance
We calculate your duty, prepare the documents and lodge everything with Revenue NSW, and we obtain the land tax clearance certificate so an unpaid charge on the land does not follow you.

Common questions
Which council is Haymarket in, and who approves development at Darling Harbour?
Haymarket is in the City of Sydney local government area. For most of the suburb the council administers Sydney Local Environmental Plan 2012 and the Sydney Development Control Plan 2012, and the City of Sydney or the Central Sydney Planning Committee is the consent authority. In the Darling Harbour precinct, which planning reports place over Darling Square and the Market City block, the City lists the State planning policy for Eastern Harbour City precincts as the controlling instrument and the Minister for Planning as consent authority for larger projects. Whether a particular address falls inside the precinct is shown on the section 10.7 certificate for that address and on the NSW Planning Portal Spatial Viewer.
Is Chinatown in Haymarket heritage listed?
Parts of it are. Sydney LEP 2012 lists individual Chinatown buildings and structures as heritage items, including the ceremonial gates and lion statues on Dixon Street (I2301), and on 6 May 2026 the council added three more: 50 to 54 Dixon Street, 90 to 100 Hay Street and 75 to 77 Ultimo Road. The council also designates Chinatown a Special Character Area with its own planning rules. Heritage is applied by map and by item, not by suburb, so whether a particular address is affected is a question for the section 10.7 certificate and the council's maps for that address.
How long is the cooling off period when I buy in Haymarket?
5 business days for an established home and 10 business days off the plan. There is no cooling off if you buy at auction, or if you agree to waive it and a section 66W certificate is provided. Before you sign, check the contract has its prescribed documents attached, including the section 10.7 planning certificate, the sewerage diagram, the title documents and, for an apartment, the strata scheme documents and by-laws. If any are missing, you can rescind the contract within 14 days of it being made.
