Sydney contracts are not all the same.
A Zetland apartment, a Surry Hills terrace and an Alexandria warehouse conversion raise different questions. We read your documents with the property type and location in mind.
What Sydney contracts often raise:
- strata levies, by-laws and building works in apartment blocks
- heritage conservation areas in older inner-city streets
- flood and acid sulfate soils notes on the planning certificate
- positive and restrictive covenants on the title
- sewer lines and easements shown on the drainage diagram
- special conditions on deposit and settlement timing
- council rates and water charges adjusted at settlement
We'll tell you what we found, why it matters and what you may want to do next.
What your free Sydney contract review covers
We read the whole contract, not just the price and settlement date. Your review is carried out by Australian property lawyers who work in NSW property law every day.
-
Contract of Sale Particulars, general conditions and special conditions, including deposit, settlement and finance terms.
-
Attached documents The title search, planning certificate, drainage diagram and any pool documents, and anything that’s missing.
-
Apartments and strata Fees, special levies, rules and any works or disputes flagged in the strata information.
-
Planning and overlays Zoning and planning controls shown on the planning certificate, and what they may mean if you want to renovate or build.
-
Title restrictions Easements, covenants and restrictions on the plan that can limit how you use the land.
-
Your next steps What to ask the agent, what to investigate and what may be worth negotiating before you commit.
Get the contract early. Read it before you fall for the house.
Many Sydney homes go to auction, and well-priced private sales can move quickly. That leaves little time to read a contract properly once you've found the right place.
In NSW the agent must have the contract before the property is advertised, so ask for it early. Send it to us after the first inspection and you'll know where you stand before the second.
You can do this for every property on your shortlist. No charge. No obligation.
What an NSW contract usually contains
The seller must attach the prescribed documents to the contract: the title search, all plans and dealings, the drainage and sewerage diagrams and the council planning certificate, plus pool registration and compliance documents if there’s a pool. For apartments, the common property search and by-laws.
It can show:
- ownership and title details
- mortgages, caveats and other registered interests
- easements, covenants and restrictions
- the planning zone and planning controls
- pool compliance documents, where there’s a pool
- sewer lines and drainage
- special conditions the seller has added
We check what's there, what's missing and what it means for you before you commit.
You stay in control.
A review doesn't tell you that you have to buy the property. It gives you information before you make the decision. Depending on what we find, you may choose to:
-
Walk away If the property or contract isn't right for you.
-
Negotiate Ask for a change to the contract, price or other terms.
-
Investigate further Get the right building, pest, planning or other advice.
-
Proceed Move forward knowing what you're agreeing to.
Get your contract reviewed before you bid.
Auction purchases are different. In NSW there’s no cooling-off at auction, or for a contract exchanged on the same day after a pass-in. That makes understanding the contract before you bid particularly important.
If you're considering bidding at auction, send us the contract before auction day so we can review it and suggest amendments to the contract that benefit you and suit what you need.
Send them all.
You're not limited to one property. If you're still searching, you can use Prepared to review the contracts you're considering before you decide which property is right for you. No charge. No obligation.
The right time to get legal advice isn't after you've bought the property. It's before you commit.
