Conveyancing in Woolloomooloo.
The apartments on the Woolloomooloo Finger Wharf are leasehold strata on State-owned land, and the NSW Supreme Court said so in 2022.
In a judgment of 16 September 2022 involving The Owners, Strata Plan No 61618, the court described the wharf as a leasehold property, divided into seven strata schemes and a hotel lot under a strata management statement, on land now owned by Transport for NSW. Behind the wharf, about one in five occupied homes in the suburb was rented from the State housing authority at the 2021 Census, a legacy of the green bans and the 1975 tripartite agreement that protected public housing and public land here from redevelopment.
Prepared reviews your contract for sale and the documents prescribed to be attached to it against what Woolloomooloo actually raises. For a wharf apartment, the head lease, the strata management statement and the State heritage listing. For a terrace or apartment in the valley, the conservation area and the flood information for the street. What is proposed on public land nearby. You get answers you can act on before the cooling off period runs out.

About Woolloomooloo
Woolloomooloo is a valley that opens to the harbour, with the Domain and Sir John Young Crescent on the west and a steep escarpment on the east rising to Potts Point. The City of Sydney flood study records drops of up to 20 metres towards Brougham Street. The Eastern Distributor, finished in 1997, separates the western edge from the Domain, and the McElhone Stairs, built in 1904, climb from Cowper Wharf Road to the top of the escarpment. There is no station in the valley; Kings Cross station is up the hill in Potts Point.
The Finger Wharf on Cowper Wharf Road is State Heritage Register item 01437, gazetted 18 April 2000, and its register entry records its use as a hotel, residential apartments, restaurants and a marina. The Gunnery at 43 to 51 Cowper Wharf Road, used as artists' studios, is item 00927, gazetted 2 April 1999. Residents formed the Woolloomooloo Resident Action Group on 8 October 1972, a green ban covered the area from 1974, and the City, State and Australian Governments signed the tripartite agreement on 27 June 1975.
What the market here means for your contract
At the 2021 Census, Woolloomooloo had 3,792 residents in 2,621 private dwellings. Flats or apartments made up 72.8% of occupied private dwellings, semi-detached, row or terrace houses and townhouses 26.1%, and separate houses 0.5%. Of occupied dwellings, 70.6% were rented, 13.9% owned with a mortgage and 13.1% owned outright, and 375 homes, about 19.5%, were rented from the State housing authority.
The practical effect is that most Woolloomooloo files are strata files, but of very different kinds: a leasehold scheme on a State listed wharf, or an apartment or terrace in a conservation area in the valley. In the lower valley the flood information matters as much as the strata records. Next to public housing land, the proposals in train are worth knowing about before you exchange.
Before you sign
In New South Wales you get 5 business days to cool off on an established home, 10 for off the plan, and none at all at auction. If you agree to waive the cooling off period and provide a 66W Certificate then no cooling off applies as well.
That is the whole window. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.

What we check in Woolloomooloo
Leasehold strata on the Finger Wharf
In Walker Corporation Pty Ltd v The Owners, Strata Plan No 61618 [2022] NSWSC 1246, the Supreme Court described the Finger Wharf as a leasehold property on State land, now owned by Transport for NSW, subdivided under the leasehold strata legislation into seven strata schemes and one hotel lot and run under a strata management statement by a building management committee. The court held one article of the statement, and a by-law requiring a common strata manager, void for uncertainty. With a leasehold lot, the time left on the lease is part of what you are buying, so we find the head lease, its term and what it says about rent, consent and expiry, and read the strata management statement as well as the by-laws.
A State listed wharf
The Finger Wharf has been on the State Heritage Register as item 01437 since 18 April 2000. The register entry lists the wharf's strata plans, 61618, 61619, 61770, 61771, 71494 and 73154, within the listing. Works to a State listed item generally need approval under the Heritage Act 1977 unless an exemption applies, and how that applies to work inside a particular apartment is a question to put to Heritage NSW before you plan a renovation. We check the listing and ask what approvals sit behind past works.
Flooding in the lower valley
The City of Sydney's Woolloomooloo floodplain risk management plan of April 2016 estimates that 148 properties would flood above floor level in a 1% annual exceedance probability event, 34 in a 20% event and 249 in the probable maximum flood. The flood study names Stream Street, Busby Lane, Crown Street, Palmer Street, Bourke Street and the Cowper Wharf Road underpass among the problem areas, with depths of about 1.2 metres in Crown Street and 1.3 metres in Palmer Street in a 100 year event, and grades flattening to about 0.5% near the bay. Whether a lot is subject to flood related controls is a question for the section 10.7 certificate and the City's flood information for the address.
The Woolloomooloo conservation area
Much of the suburb is in the Woolloomooloo heritage conservation area, identified in City of Sydney reports as C71 in Sydney LEP 2012. Individual buildings are listed as well: the Calidad Building at 163 Brougham Street was added as local item I2222 by Amendment No 14 in 2014. Some sites also carry their own controls, such as 47 to 51 Riley Street, where Amendment No 112, published on 5 September 2025, set a height of RL 25.5 metres and a floor space ratio of 3.2:1 under a new clause 6.60M. We check the LEP maps and the certificate for the address rather than assuming the conservation area controls are the only ones.
Public housing and live proposals
At the 2021 Census about 19.5% of occupied dwellings in Woolloomooloo were rented from the State housing authority and a further 1.7% from community housing providers. On 9 October 2026 Homes NSW announced 15 social homes on vacant government land in Nicholson Street, with a development application to the City of Sydney planned for December 2026. Two State significant development applications for affordable housing, at 164 to 194 William Street and at 134 William Street, were on the Planning Portal when we checked in November 2026. None of these was approved at that date; we tell you what is proposed near the address and where to follow it.

Prescribed documents and the 10.7 certificate

Settlement and statement of adjustments
We prepare and check settlement figures, including council rates, water rates, strata levies and other adjustments, so nothing is wrong on the day.
Electronic settlement
Land dealings in New South Wales must be lodged electronically, and certificates of title were cancelled in October 2021. We run the whole process securely and keep you informed at each step.
Strata due diligence
Buying an apartment or townhouse means buying into a strata scheme. We review the section 184 certificate, the records, financial statements, by-laws, the capital works fund, maintenance obligations and any known issues.
Easements, covenants and title restrictions
We explain everything affecting the title, including easements, restrictions on the use of land and positive covenants created by a section 88B instrument, caveats, mortgages and other registered interests that could limit what you do with the property.
Transfer duty and land tax clearance
We calculate your duty, prepare the documents and lodge everything with Revenue NSW, and we obtain the land tax clearance certificate so an unpaid charge on the land does not follow you.

Common questions
Are Finger Wharf apartments freehold?
No. The NSW Supreme Court described the Finger Wharf in 2022 as a leasehold property on State land, now owned by Transport for NSW, divided into strata schemes and a hotel lot under a strata management statement. Before you exchange, read the head lease term and the statement, not just the strata by-laws.
Does Woolloomooloo flood?
Parts of the lower valley can. The City of Sydney's April 2016 floodplain risk management plan estimates that 148 properties would flood above floor level in a 1% annual exceedance probability event, with Crown, Palmer, Bourke and Stream Streets among the problem areas. Whether a particular lot is subject to flood related controls is shown on the section 10.7 certificate and in the City's flood information for the address.
Which council is Woolloomooloo in?
Woolloomooloo is in the City of Sydney local government area and is governed by Sydney Local Environmental Plan 2012, which includes the Woolloomooloo heritage conservation area, C71. Garden Island next door is Commonwealth Defence land and is listed with a Potts Point address. The section 10.7 certificate for the address shows which controls apply.
