Conveyancing in Erskineville.

Erskineville began as the Municipality of Macdonaldtown, incorporated in 1872 and renamed in 1893, and much of its terrace housing now sits in heritage conservation areas such as Burren Estate.

South of Ashmore Street, between Mitchell Road and the railway, the 17 hectare Ashmore precinct is a former Metters and McPhersons factory estate being rebuilt for around 6,000 residents. City of Sydney reports on Ashmore sites record contaminated fill, remediation action plans and floor levels lifted above flood levels in the Alexandra Canal catchment. A terrace and a new Ashmore apartment a few streets apart can raise very different questions in the contract.

Prepared reviews your contract for sale and the documents prescribed to be attached to it against what Erskineville actually raises. Whether the section 10.7 certificate places the address in a heritage conservation area or on a heritage item. What the certificate reports on contamination, which on a former factory estate is far less than buyers assume. Flood planning in the Alexandra Canal catchment. For a newer Ashmore apartment, the strata records, the building bond and any environmental management obligations left by remediation. You get answers you can act on before the cooling off period runs out.

About Erskineville

Erskineville was incorporated as the Municipality of Macdonaldtown on 23 May 1872 and renamed Erskineville in 1893, according to the City of Sydney Archives. Erskineville Road is the main street, with the Imperial Hotel at 35 to 37 and the 1938 Erskineville Town Hall at 104, now a City of Sydney venue. Erskineville station, on Swanson Street beside Erskineville Road, was rebuilt as a four platform Illawarra line station between 1910 and 1913. Transport for NSW moves Erskineville and St Peters stations to the T4 Eastern Suburbs and Illawarra Line from Sunday 15 November 2026.

Erskineville Oval at 149 Mitchell Road began as 22 acres proclaimed Macdonaldtown Park in 1885, renamed Erskineville Park in 1892. Newtown's rugby league side played there from 1913 to 1954, and in 1937 part of the park was taken for the Erskineville Housing Scheme of 16 blocks of flats. South of Ashmore Street, the Ashmore precinct runs between Mitchell Road, Coulson Street and the railway, with McPherson Park at its centre and Kooka Walk linking Harry Noble Park to Sydney Park, the former brickworks and municipal tip to the south. The Imperial Hotel was added to the State Heritage Register as item 02102 on 21 March 2025 for its place in the LGBTQIA+ community since 1983, and the former Bakewell Brothers south east warehouse in Coulson Street is a local heritage item.

What the market here means for your contract

At the 2021 Census, Erskineville had 9,657 residents in 5,204 private dwellings, with an average household of 2 people. Of occupied private dwellings, 61.7% were flats or apartments, 34.5% semi-detached, row or terrace houses and townhouses, and 3.2% separate houses. 53.3% were rented, 32.5% owned with a mortgage and 12.7% owned outright. Two bedroom dwellings were the largest group, at 50.7%.

The practical effect is two different kinds of file. About a third of homes are terraces and semis, where the heritage and flood entries on the section 10.7 certificate, the sewerage service diagram and the history of building work on the house carry most of the weight. The majority are apartments, increasingly in the newer Ashmore buildings, where the section 184 certificate, the strata records, the building bond and any obligations carried over from site remediation tell you more about the lot than the contract does.

Before you sign

In New South Wales you get 5 business days to cool off on an established home, 10 for off the plan, and none at all at auction. If you agree to waive the cooling off period and provide a 66W Certificate then no cooling off applies as well.

That is the whole window. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.

What we check in Erskineville

Ashmore was a factory estate first

The City of Sydney's 2013 planning proposal for the two largest Ashmore sites records that the precinct was the site of Metters Ltd, makers of cast iron goods and kitchen and bathroom ware, and of McPhersons, which made bolts, nuts, rivets and machinery until the 1940s, and expected some contamination from those heavy metal industries. Those two sites stayed under South Sydney Local Environmental Plan 1998 until an amendment brought them into Sydney Local Environmental Plan 2012 in July 2014. City reports on 155 Mitchell Road (February 2025) and 7 to 19 Coulson Street (May 2025) record heavy metals, hydrocarbons and asbestos in fill, remediation action plans under the State Environmental Planning Policy (Resilience and Hazards) 2021, and interim advice from an accredited site auditor. A section 10.7 certificate reports only the contamination matters listed in section 59(2) of the Contaminated Land Management Act 1997, so it can say nothing about any of this. We look for a site audit statement and any long term environmental management plan, and ask whether it places ongoing obligations on the owners corporation.

Flood planning in the Alexandra Canal catchment

Erskineville is in the City of Sydney's Alexandra Canal floodplain catchment. The catchment's flood study, floodplain risk management study and plan were adopted in March 2014, followed by a 2020 flood study. The City consulted from 14 October to 11 November 2025 on updating the plan for the Alexandra Canal and Centennial Park catchment, and that update is under review, not adopted. A 2013 City report placed flooding mainly around Ashmore Street, Macdonald Street and the corner of Mitchell Road and Coulson Street. Since then the City and Sydney Water have built a trunk drain in the Macdonald Street upgrade, McPherson Park is designed to double as a detention basin, and the May 2025 report on 7 to 19 Coulson Street records future ground levels raised 0.9 to 2.3 metres. Whether flood related development controls apply to an address is reported on its section 10.7 certificate, and we read that alongside the council's flood information.

Heritage conservation areas across the terraces

Much of Erskineville's terrace housing sits in heritage conservation areas under Sydney Local Environmental Plan 2012, among them Burren Estate (C21), Kingsclear (C3) and Malcolm Estate (C24), as identified in City of Sydney planning reports. Within a conservation area the City's building contributions map grades each building as contributory, neutral or detracting. The Ashmore sites assessed in 2025 are outside any conservation area, so two addresses a short walk apart can sit under different heritage controls. The City's conservation areas review, approved by the Central Sydney Planning Committee in August 2025, did not list boundary changes in Erskineville in its post exhibition report. Conservation areas are applied by map, so whether an address is affected is a question for its section 10.7 certificate and the council's maps.

Strata records in the newer Ashmore buildings

Most of Erskineville's newer apartments are in Ashmore, where the 57 Ashmore Street estate has been built in phases under concept approval D/2015/966 and further stages and sites were still before the City of Sydney in 2025. Home building compensation cover is not required for new buildings with a rise in storeys of more than three containing multiple units. For those buildings a buyer relies on other protections: the duty of care in section 37 of the Design and Building Practitioners Act 2020, the powers of Building Commission NSW over serious defects, and any strata building bond inspection reports. We read the section 184 certificate and the strata records for defect reports, bond inspections, any environmental management plan from the remediation consent, and whether the streets and parks around the building have been finished and handed to the council.

What the planning rules allow on Erskineville Road

Erskineville Road carries its own entries in Sydney Local Environmental Plan 2012. The Sydney Local Environmental Plan Amendment (Night Time Economy) 2022, published 9 December 2022, added a Schedule 1 clause permitting entertainment facilities with consent on the Town Hall land at 104 Erskineville Road. The Imperial Hotel at 35 to 37 Erskineville Road was added to the State Heritage Register on 21 March 2025, on top of its existing local listing, recognising its place in the LGBTQIA+ community since 1983 and its drag shows. If you are buying on or close to the strip, we check the zone and any heritage listing the section 10.7 certificate reports for the address, and the strata by-laws on noise, so you know what can happen next door before you commit.

How we help in Erskineville

Contract for sale reviews

Before you sign anything, we review the contract for sale and explain the terms, special conditions and risks that could affect your purchase.

Prescribed documents and the 10.7 certificate

The documents attached to the contract carry the section 10.7 planning certificate, the title and plan, the sewerage diagram, easements and restrictions, and for strata the scheme documents and by-laws. We explain what they mean and flag anything that deserves a closer look.

Property conveyancing

Buying or selling, we manage the legal transfer of ownership, prepare the documents and coordinate every party through to settlement.

Settlement and statement of adjustments

We prepare and check settlement figures, including council rates, water rates, strata levies and other adjustments, so nothing is wrong on the day.

Electronic settlement

Land dealings in New South Wales must be lodged electronically, and certificates of title were cancelled in October 2021. We run the whole process securely and keep you informed at each step.

Strata due diligence

Buying an apartment or townhouse means buying into a strata scheme. We review the section 184 certificate, the records, financial statements, by-laws, the capital works fund, maintenance obligations and any known issues.

Easements, covenants and title restrictions

We explain everything affecting the title, including easements, restrictions on the use of land and positive covenants created by a section 88B instrument, caveats, mortgages and other registered interests that could limit what you do with the property.

Transfer duty and land tax clearance

We calculate your duty, prepare the documents and lodge everything with Revenue NSW, and we obtain the land tax clearance certificate so an unpaid charge on the land does not follow you.

Common questions

Which council is Erskineville in?

Erskineville is in the City of Sydney local government area. The council administers Sydney Local Environmental Plan 2012 and the Sydney Development Control Plan 2012, which has its own section for the Ashmore neighbourhood south of Ashmore Street. The section 10.7 planning certificate for an address is issued by the council and names the instruments that apply to it.

Is Erskineville in a heritage conservation area?

Much of it is, but not all of it. City of Sydney reports place parts of Erskineville in the Burren Estate (C21), Kingsclear (C3) and Malcolm Estate (C24) heritage conservation areas, while the Ashmore sites assessed in 2025 sit outside any conservation area. Separate heritage items include the Imperial Hotel, on the State Heritage Register since 21 March 2025. Conservation areas and items are applied by map, so check the section 10.7 certificate and the council's heritage maps for the specific address.

Which train line stops at Erskineville?

From Sunday 15 November 2026, Erskineville and St Peters stations move to the T4 Eastern Suburbs and Illawarra Line, according to Transport for NSW, giving direct trains to Martin Place and Bondi Junction. Erskineville station is on the Illawarra line beside Erskineville Road. Check the Transport for NSW timetable for the services running on the day you need them.
