Prepared is an Australian legal practice focused on residential property transactions. We provide fast, expert contract reviews and related conveyancing services.
These Terms apply to www.prepared.com.au and any other websites, subdomains or apps we operate that link to these Terms.
These Terms of Use (“Terms”) govern your access to and use of our website, apps, and services (together, the “Services”). By using the Services, you agree to these Terms. If you don’t agree, please don’t use the Services.
Information vs Advice
Our website includes quotes, buyer and seller information and blogs for information purposes. General information on our site is not legal advice. Many factors unknown to Prepared may affect the applicability of any information on the website.
No Client–Lawyer Relationship (Until Engaged)
Submitting a form or uploading a contract does not create a solicitor–client relationship or urgent retainer. A relationship forms only when we confirm engagement in writing after conflict checks are performed.
We may decline matters due to conflicts, capacity, jurisdiction, or risk. Prepared Legal Services issuing you with a Disclosure Statement and Cost Agreement is an offer to perform services on those terms.
Accuracy
The information on the Prepared Legal Services website (“the website”) may not be accurate or up to date in all instances. We do not warrant the quality, accuracy or completeness of any information on our website. Please do not use website content as a substitute for seeking legal advice.
Eligibility & Your Responsibilities
- You must be at least 18 and have authority to act for yourself or as an authorised representative of another.
- You promise the information you provide is true, accurate and complete, and that you have the right to upload any documents you submit (including contracts).
Privacy & Cookies
We handle personal information as described in our Privacy Policy. By using the Services you acknowledge the Privacy Policy and consent to necessary cookies. Where required by law, we’ll seek your consent for optional analytics and marketing cookies.
Acceptable Use
You agree not to:
- Break the law or infringe others’ rights;
- Upload malware, attempt to access non-public areas, or interfere with the Services;
- Use automated scraping or harvesting tools without our written consent;
- Misrepresent our analysis as your own professional legal advice.
Quotes and Service Information
Upfront Pricing
Where shown, fixed or advertised prices apply to defined services and assumptions. If your matter falls outside scope (e.g., unusual complexity or urgent after-hours action), we’ll tell you the options and costs before proceeding.
Pricing, Payments & Refunds
Advertised prices apply to defined services and assumptions. Before work outside scope proceeds, we’ll confirm options and fees. You authorise our payment provider to charge your selected method.
If we cannot complete a paid service (e.g., due to conflict or capacity), we’ll refund any unperformed portion. Your rights under the Australian Consumer Law apply in addition to these Terms.
Fast, Not Reckless
We’re built for speed and clarity, but timing depends on when we receive complete documents, the property type, complexity and third-party responses. We’ll always act reasonably to meet stated timeframes.
Intellectual Property
- Ours: We (or our licensors) own all IP in the Services, including logo, branding, content, reports, workflows and technology. You must not copy, compile, disseminate, extract, modify, reproduce, publish, reverse-engineer or create derivative works from our Services.
- Yours: You own the documents and data you supply. You grant us a licence to use that material to provide the Services, operate and improve our systems, comply with law, and maintain records.
Errors and Amendments
The content found herein may contain inaccuracies and typographical errors, and Prepared does not warrant the accuracy, reliability or completeness of any such information.
Prepared reserves the right to revise or remove information from our website at any time.
Liability Limits
To the maximum extent permitted by law:
- We exclude all implied warranties not expressly set out in these Terms;
- Our liability for non-excludable guarantees is limited to resupplying the relevant services or paying the cost of resupply;
- We’re not liable for indirect or consequential loss, loss of profit, business interruption or loss of opportunity.
If a cap applies at law, our aggregate liability for direct loss relating to the Services is limited to the fees you paid for the relevant service in the prior 12 months. Nothing in these Terms excludes liability under the Australian Consumer Law where it cannot be excluded.
Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and courts that hear appeals from them.
If any part of these Terms is invalid, the rest remains in force (severability). A failure to enforce isn’t a waiver. These Terms constitute the entire agreement regarding your use of the Services.
Optional third-party services (opt-in)
Certain services provided by third parties are optional but may be beneficial to you should you eventually purchase a property. You may be presented with an opportunity to opt in to further services. We will only share your contact details (name, contact number and contact email address) with these providers if you provide your explicit consent to do so. We may receive a referral payment if you choose to use these optional third-party services.
Stewart Title Australia - we receive the following benefits:

$55 processing fee (excl. GST) on each policy towards the time spent ordering the policy on your behalf

Stewart Title waives any rights and remedies or relief to which they become entitled to in their policies by way of subrogation against us.

An indemnity where a claim is brought against us with respect to a matter that would be covered under the Stewart Title policies
Despite this relationship, we are not obliged to use Stewart Title exclusively and you may request our help with a different provider. We are not an agent of Stewart Title and have no authority to bind them in any way. From time to time, we may add or remove businesses from this list. Please contact us if you would like a current list of all third-party service providers available during your transaction.
