Conveyancing in Eveleigh.
Eveleigh is the railway workshops suburb: the Eveleigh Railway Workshops site is on the State Heritage Register as item 01140, and the 2021 Census counted only 303 private dwellings here.
One of the few privately owned residential sites is the four building strata scheme at 49 Henderson Road, Strata Plan 77095, where the City of Sydney describes the landscaped area known as South Sydney Rotary Park #2 as private land owned by the owners corporation, with unrestricted public access required by the development approval.
On 28 April 2026 the council approved an agreement to remove the outdoor gym there, and its report states that the owners corporation will then be solely responsible for ongoing maintenance.

About Eveleigh
Eveleigh is the land of the old railway workshops. The State agency heritage register entry for the Eveleigh Railway Workshops runs from Wilson Street and Leamington Avenue in the north to Railway Parade and Henderson Road in the south, and from the western end of the Redfern station platforms to Swanson Street, Burren Street and Iverys Lane in the west. North of the main line, the Carriage Workshops built between 1880 and 1889 are leased to Carriageworks, after a conversion into an arts centre that the NSW Government began in 2007. South of the line, the Locomotive Workshops stopped work in 1986, became the Australian Technology Park in the 1990s and, after Mirvac bought the site in 2015, the South Eveleigh precinct.
The whole workshops site is on the State Heritage Register as item 01140, with the workshop machinery listed separately as 01141 and the Chief Mechanical Engineer's Office as 01139. A site specific exemptions order for item 1140, made on 5 March 2015 and published in the Government Gazette on 13 March 2015, sets out maintenance and minor works that do not need separate Heritage Council approval. Since 15 December 2023 the Sydney Local Environmental Plan 2012 has also listed the Eveleigh Paint Shop and three neighbouring Wilson Street buildings as heritage items of State significance, I2297 to I2300. South Sydney Rotary Park, bounded by Henderson Road, Railway Parade, Progress Road and Explorer Street, opened in 1996 on former railway workshop land.
What the market here means for your contract
At the 2021 Census, Eveleigh had 606 residents in 303 private dwellings, 26 of them unoccupied, with an average household size of 2.1 people. Flats or apartments made up 86.0% of occupied private dwellings and semi-detached, row or terrace houses and townhouses 11.3%. The Census counted no separate houses. Of occupied private dwellings, 74.0% were rented, 18.5% owned with a mortgage and 2.6% owned outright, and two bedroom dwellings were the most common at 39.9%.
The practical effect is that a private purchase in Eveleigh is usually a strata purchase from a small pool. A large part of the housing is social and affordable rental: Homes NSW owns the 46 townhouses on Explorer Street, Station Place and Aurora Place, and City West Housing describes its 88 Platform Apartments in the Carriageworks precinct as affordable housing. That leaves the section 184 certificate, the by-laws and the strata records doing most of the work, and with so much of the stock rented, a lot sold with a tenant in place needs the lease and bond dealt with in the contract.
Before you sign
In New South Wales you get 5 business days to cool off on an established home, 10 for off the plan, and none at all at auction. If you agree to waive the cooling off period and provide a 66W Certificate then no cooling off applies as well.
That is the whole window. If the property is going to auction, the review has to happen before you raise your hand, and it costs you nothing to have it done. There is no reason to be the person who finds out afterwards.
Local detail
What we check in Eveleigh
Common property the public may use
The City of Sydney describes the landscaped land at 49 Henderson Road as private land owned by the owners corporation of Strata Plan 77095. The 2003 approval for four integrated buildings with 115 residential units requires unrestricted public access to that area, and the council says it maintained the turf for about 20 years without a formal agreement. The Local Planning Panel approved removal of the outdoor gym equipment on 23 July 2025 (D/2025/299), and on 28 April 2026 the council approved an access agreement with the owners for those works; its report states the owners corporation will then be solely responsible for ongoing maintenance. We read the minutes, the ten year capital works fund plan and the insurance schedule for how the scheme is budgeting for, and insuring, land the public is entitled to use.
Which planning instrument the certificate names
Eveleigh is split between the State planning policy for Eastern Harbour City precincts, whose Appendix 3 covers the Redfern Waterloo Authority sites, and Sydney Local Environmental Plan 2012. Land at South Eveleigh is still in Appendix 3, which was amended for the Large Erecting Shop there on 9 June 2023. The Paint Shop sub-precinct moved into the Sydney plan when its rezoning commenced on 15 December 2023, the Explorer Street estate followed on 17 October 2025 with R1 General Residential and RE1 Public Recreation zones, and the panel assessed 49 Henderson Road under the Sydney plan in the R1 zone in July 2025. On land still in Appendix 3 the council's own guide says the Planning Minister is the consent authority for development with a capital investment value over 10 million dollars, with smaller applications decided by the council under ministerial delegation. We check which instrument and zone the section 10.7 certificate for the address names.
Workshops heritage and Heritage Council approval
The Eveleigh Railway Workshops listing, State Heritage Register item 01140, covers the whole workshops site, and work to an item on the Register generally needs approval under section 57(1) of the Heritage Act 1977 unless an exemption applies. The site specific exemptions order for item 1140, made on 5 March 2015, lists maintenance and minor works that are exempt. Separately, Schedule 5 of the Sydney plan has listed four Wilson Street buildings on Lot 5 DP 1175706, including the Eveleigh Paint Shop, as items I2297 to I2300 since 15 December 2023. Whether a particular lot sits inside the State listing or near a listed item is shown on the section 10.7 certificate and the register, so we read both rather than assume a residential lot is outside them.
Rezoned land around the homes
The Explorer Street rezoning, in force from 17 October 2025, covers about 2.3 hectares including the 46 Homes NSW townhouses and South Sydney Rotary Park, and allows up to 400 homes in buildings up to 13 storeys (RL 60.7 metres), with at least half the residential floor space to be social and affordable housing. The Paint Shop sub-precinct on Wilson Street was rezoned for about 320 dwellings, and in July 2026 part of the Clothing Store sub-precinct passed from Transport for NSW to Homes NSW for early planning. Development applications for these sites are still to come. A section 10.7 certificate reports the controls on the land you are buying, not what its neighbours may become, so we read the State rezoning pages alongside it.
Check the lot, not the suburb name
Addresses at the edge of Eveleigh have moved. The council records that 49 Henderson Road was previously known as 121 Henderson Road, Alexandria, and its own history of South Sydney Rotary Park places the park in Alexandria, while the State's Explorer Street rezoning places the same ground in Eveleigh. The council's July 2025 report also notes that a railway corridor runs underground through the 49 Henderson Road site, and the Explorer Street proposal calls for building design that deals with rail noise and vibration. We match the lot and plan in the contract to the title search, the sewerage diagram and the certificate, and read the title for any registered interest affecting the land.

How we help in Eveleigh
Contract for sale reviews
Before you sign anything, we review the contract for sale and explain the terms, special conditions and risks that could affect your purchase.
Prescribed documents and the 10.7 certificate
The documents attached to the contract carry the section 10.7 planning certificate, the title and plan, the sewerage diagram, easements and restrictions, and for strata the scheme documents and by-laws. We explain what they mean and flag anything that deserves a closer look.
Property conveyancing
Buying or selling, we manage the legal transfer of ownership, prepare the documents and coordinate every party through to settlement.
Settlement and statement of adjustments
We prepare and check settlement figures, including council rates, water rates, strata levies and other adjustments, so nothing is wrong on the day.
Electronic settlement
Land dealings in New South Wales must be lodged electronically, and certificates of title were cancelled in October 2021. We run the whole process securely and keep you informed at each step.
Strata due diligence
Buying an apartment or townhouse means buying into a strata scheme. We review the section 184 certificate, the records, financial statements, by-laws, the capital works fund, maintenance obligations and any known issues.
Easements, covenants and title restrictions
We explain everything affecting the title, including easements, restrictions on the use of land and positive covenants created by a section 88B instrument, caveats, mortgages and other registered interests that could limit what you do with the property.
Transfer duty and land tax clearance
We calculate your duty, prepare the documents and lodge everything with Revenue NSW, and we obtain the land tax clearance certificate so an unpaid charge on the land does not follow you.

Common questions
Which council is Eveleigh in?
Eveleigh is in the City of Sydney local government area, but the council is not always the consent authority there. On land still in the Redfern Waterloo Authority sites, the council's planning guide says the Planning Minister decides development with a capital investment value over 10 million dollars and the council decides smaller applications under ministerial delegation. The Paint Shop sub-precinct, the Explorer Street estate and the strata scheme at 49 Henderson Road are now under Sydney Local Environmental Plan 2012, and the section 10.7 certificate for the address will name the instrument that applies.
Is Eveleigh heritage listed?
The Eveleigh Railway Workshops are on the State Heritage Register as item 01140, and the listing covers the whole workshops site rather than single buildings. Four Wilson Street buildings, including the Eveleigh Paint Shop, have also been local heritage items of State significance under the Sydney plan since 15 December 2023. Heritage is applied by map and by lot, so whether a particular address is affected is a question for the section 10.7 certificate and the register.
Are there houses for sale in Eveleigh?
Very few: the 2021 Census counted no separate houses in Eveleigh, and 86.0% of occupied dwellings were flats or apartments. The 46 townhouses on Explorer Street, Station Place and Aurora Place are social housing owned by Homes NSW, so a private purchase here is usually a lot in a strata scheme. That makes the section 184 certificate, the by-laws and an inspection of the strata records the core of the review.
